We are elated to bring to you the Seventh Issue of the Third Volume of the CADR Newsletter.
The world of ADR is brimming with new developments and the month of July is the testament to the same.
The Supreme Court of India in two different judgments – PSA SICAL Terminals (P) Ltd. v. V. O. Chidambranar Port Trust and NHAI v. Hakeem – interpreted the section 34 of the Arbitration and Conciliation Act which deals with ‘setting aside’ of an arbitral award by explaining it lucidly. In the world of International Commercial Arbitration, fresh arbitration rules of the Vienna International Arbitration Centre (VIAC) entered into force on 1 July, 2021 and the English High Court allowed the shareholders of a company to serve out the “joinder application” to four of its associated companies.
Investment Arbitration too saw some major disputes with France based cement production company Vicat taking up a dispute against the Egyptian government, to the International Centre for Settlement of Investment Disputes (ICSID). The Chief Justice of India NV Ramana called upon to make mediation as the foremost method to settle disputes and also advised (in a different case) the fighting members of the renowned Kirloskar family to explore the route of mediation instead of filing civil disputes on each other.

It’s been a busy month for us at CADR too, as we continue serving the ADR Community with events and research. In a landmark feat, a Memorandum of Understanding (MoU) was signed between the Rajiv Gandhi National University of Law, Punjab (RGNUL) and Beihai Asia International Arbitration Centre Pte Ltd (BAIAC) with a desire to promote the learning, teaching and research of Alternative Dispute Resolution methods along with strengthening and expanding the mutual contacts between both the organizations on 20th July, 2021.
It’s been a hectic month for CADR Blog too! Seat vs Exclusive Jurisdiction Clauses: A Tale of Three Cities, Mediate, don’t litigate? Analyzing the effectiveness of mediation in the farm laws dispute were some of the important topics on which blogs were published in June. The Blog continues to accept submissions on a rolling basis.
The Newsletter initiative began with the observation that there exists a lacuna in the provision of information relating to ADR to the practicing community, and we wanted to provide a solution to the same. In keeping with that, we are glad to have many practitioners and students subscribe to the Newsletter and the Blog after the launch of the first issue.
