We are elated to bring to you the Fifth Issue of the Third Volume of the CADR Newsletter.
May has been a truly eventful month in the ADR world.
The Supreme Court of India confirmed the principle of Party Autonomy during the process of forum selection for Arbitrations outside India, a Chandigarh based startup launched India’s first Online Dispute Resolution Platform, the Supreme Court (in another case) held that the existence of an arbitration clause will not debar Courts from entertaining writ petitions, and Cairn Energy PLC has threatened to seize assets owned by the Government of India abroad to realize the USD 1.4 Billion claim that was awarded in its favour a few months ago.
In the realm of Mediation, former Attorney General of Australia agreed to resolve a defamation claim amicably and withdrew his suit, a mediation team from Economic Community of West African States (“ECOWAS”) was permitted to meet the detained Prime Minister and President of Mali, and the England and Wales Court of Appeal held that mediation position statements made in one of the parties’ confidential position papers were admissible in evidence.

It’s been a busy month for us at CADR too, as we continue serving the ADR Community with events and research. CADR is organizing an International Virtual Conference on Regulation of Sports and Entertainment Law, in collaboration with Jagran Lakecity University, Bhopal. The Conference is scheduled to be held on August 1, 2021.
It’s been a busy month for the CADR Blog as well! Emergency Arbitration: A New Phase in the Indian Arbitration Regime, Binding Non-Signatories to International Commercial Arbitration Agreements and India as an International Commercial Arbitration Hub vis-a-vis its Conflict of Laws System were some of the blogs published in May. The Blog continues to accept submissions on a rolling basis.
The Newsletter initiative began with the observation that there exists a lacuna in the provision of information relating to ADR to the practicing community, and we wanted to provide a solution to the same. In keeping with that, we are glad to have many practitioners and students subscribe to the Newsletter and the Blog after the launch of the first issue.
